David G. Benner is a former judge in the United States Court of Appeals for the Eleventh Circuit, and a professor in the Department of Law at Emory University. He joined the public service of the United States in 2001, when he became a judicial law clerk to Judge Manuel Real Jr. of the U.S
Court of Appeals for the Fifth Circuit in New Orleans. In 2005 he became a law clerk to Judge David Sentelle on the U.S. Supreme Court's retrial panel for Hamdan v.
Rumsfeld, where he argued one of the five cases before that Court in 2005 and 2006. His research interests include criminal procedure, legal ethics, and legal history. He is also a freelance writer - his book A Taxing Affair: The Legal Battle over Tobacco Protection in America was published by Yale University Press in 2010/11 - and has been a frequent contributor to various publications including The Huffington Post and National Review Online.
